Due to the spread of COVID-19 (novel coronavirus infection), the food delivery market in Korea has grown rapidly as more and more consumers are ordering food instead of eating out.
As the size of the market expanded rapidly, side effects started to appear. A typical example of a side effect is the difficulty of recruiting deliverymen. While the number of people ordering food has increased exponentially, the number of drivers who can deliver is very limited.
As a result, delivery platform companies entered into fierce competition for recruiting deliverymen and recklessly recruited to secure insufficient delivery workers. Foreigners were no exception to the target of employment. In addition, as delivery costs have risen, even from the perspective of foreigners, part-time delivery is known as a job that can earn a high income in a short time, drawing attention as a part-time job that anyone wants.
However, the problem is that depending on the type of visa they have, it may be illegal for a foreigner to work as a delivery man. Foreigners who can work as deliverymen are very limited to those who have a residence visa (F-2), permanent residence visa (F-5), or marriage immigrant visa (F-6).
Foreigners holding a study visa(D-2) can only work hourly part-time for up to 20 hours per week or up to 30 hours per week(for master's and doctoral degrees). Foreigners holding an overseas Korean visa (F-4) cannot work in simple labor industries such as delivery. This is because the delivery driver field is a typical job for the common people, so the employment of foreigners is strictly restricted.
Legal punishment is never light. If a foreigner holding a visa that is not allowed to work in the delivery business is caught delivering delivery, they are subject to imprisonment for up to three years or a fine of up to 20 million won under Article 94 of the Immigration Control Act.

코로나19(신종 코로나바이러스 감염증)의 확산 이후, 외식을 하는 대신 음식을 주문해 먹는 소비자들이 늘어나면서 한국의 배달 시장은 급성장했다.
시장의 규모가 급속도로 팽창한 만큼 이에 따른 부작용도 나타나기 시작했다. 부작용 사례로 꼽히는 대표적인 예가 기사 구인난이다. 음식을 주문하는 이들이 기하급수적으로 증가한 것에 반해 배달을 할 수 있는 기사의 수는 매우 제한적이었기 때문이다.
이에 배달 플랫폼 업체들은 치열한 ‘기사 모시기’ 경쟁에 돌입했고 부족한 배달원을 확보하고자 무분별한 채용을 진행했다. 고용의 대상엔 외국인도 예외는 아니었다. 또한 배달 비용이 상승함에 따라, 외국인 입장에서도 짧은 시간 내에 고소득을 올릴 수 있는 일자리로 입소문이 나면서 누구나 희망하는 아르바이트로 인기를 끌었다.
그러나 문제는 소지하고 있는 비자의 종류에 따라 외국인의 배달 기사 근무 행위가 불법이 될 수도 있다는 점이다. 배달대행기사로 일할 수 있는 외국인은 거주비자(F-2)나 영주비자(F-5), 결혼이민비자(F-6) 등을 소지한 이들로 극히 제한적이다.
유학 비자(D-2)를 소지한 외국인은 주당 최대 20시간 또는 최대 30시간(석박사의 경우) 이내의 시간제 아르바이트만 가능하다. 재외동포 비자(F-4)를 소지하고 있는 외국인은 배달과 같은 단순 노무 업종엔 취업할 수 없다. 배달기사 분야는 전형적인 서민을 위한 일자리이기 때문에 외국인의 취업을 엄격히 제한하고 있기 때문이다.
법적 처벌도 결코 가볍지 않다. 배달 업종에 종사할 수 없는 비자를 소지한 외국인이 배달을 하다가 적발되면 출입국관리법 제94조에 의해 3년 이하의 징역이나 2천만원 이하의 벌금이 부과된다.
